Terms of Use

These terms govern your use of CallOnReply, operated by liebhardt.io UG (haftungsbeschränkt), Nußbaumstr. 29, 66121 Saarbrücken, Germany ("we", "us"). By creating an account or otherwise using the service you agree to be bound by them.
1. The service
CallOnReply connects to email inboxes you authorize — Gmail via OAuth, or any IMAP/SMTP mailbox using credentials you supply — and to your tracked outreach, in order to surface real-time engagement signals (replies, clicks) as push notifications. Features and capabilities may change as the product evolves; we will not materially reduce paid features without notice.
CallOnReply is a signal-detection tool, not a lead provider. We do not supply, sell, license, or curate prospect lists, contact data, or leads of any kind. All recipient data, message content, sending cadence, targeting, and consent handling are determined and supplied solely by you. You are the sender and the data controller for your outreach, and you are solely responsible for ensuring that each message you send — and each contact you upload — complies with applicable law (including GDPR, CAN-SPAM, CASL, and equivalent anti-spam, privacy, and marketing-consent regimes), with the terms of your mail provider, and with any third-party rights. We make no representation that any contact you load into the service has consented to be contacted or is appropriate to contact.
2. Account and access
- You are responsible for activity under your account.
- You must keep authentication tokens secure and notify us of any suspected unauthorized access.
- You must have the right to connect any inbox you authorize and to process the contact data you upload.
- When you connect an inbox via IMAP/SMTP credentials, you confirm that you are the legitimate account holder, or that you have explicit authorization from the account holder, and that supplying those credentials to us does not violate the terms of your mail provider. We store such credentials encrypted at rest and use them read-only to detect inbound replies; SMTP credentials are not used to send mail at this time. You may revoke access at any time by deleting the inbox from the integrations page, which erases the stored credentials immediately.
3. Acceptable use
You agree not to:
- Use the service to send unlawful, harassing, or fraudulent communications.
- Circumvent or attempt to circumvent rate limits, security controls, or access scopes.
- Reverse-engineer the service except to the extent permitted by law.
- Use the service to violate third-party rights or applicable anti-spam laws (CAN-SPAM, GDPR, TCPA, etc.).
4. Your data
You retain ownership of the data you upload or that we collect on your behalf. You grant us a limited license to process that data solely to operate the service. Our handling of personal data is described in the Privacy Policy.
5. Pricing and billing
During private alpha, the service is provided free of charge. Production pricing, billing terms, and refund policy will be presented at the time of subscription and are subject to your acceptance.
6. Availability and changes
We aim for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where practicable.
7. Termination
You may delete your account at any time. We may suspend or terminate access for breach of these terms, suspected abuse, or where required by law.
8. Disclaimer and liability
The service is provided "as is". To the maximum extent permitted by law, we disclaim all implied warranties. Our aggregate liability for any claim is limited to the fees paid by you in the twelve months preceding the claim, or, during the free alpha, to one hundred euros.
9. Governing law
These terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. Exclusive venue lies with the courts of Saarbrücken, Germany, unless mandatory consumer-protection law provides otherwise.
